4. Scope of Marketing Services

User agrees that any and all activities undertaken through the BackPac platform – including but not limited to incorporating licensed music into User’s content, creating and posting promotional videos, and other influencer engagement – are performed as marketing and promotional services on behalf of BackPac and its clients. Accordingly, any compensation the User earns via the platform is exclusively for the provision of such marketing services.

5. Independent Contractor & Tax Obligations

User acknowledges that they are participating as an independent contractor (or independent service provider, in the case of a business entity) and not as an employee of BackPac. The User is solely responsible for any taxes, duties, or other governmental charges arising from compensation earned through the platform. BackPac may be required to withhold applicable taxes from payments to the User as mandated by law or regulation, including but not limited to backup withholding requirements imposed by the IRS. Users acknowledge that such withholding will be made in compliance with applicable laws. The User agrees to provide any tax documentation requested by BackPac (e.g., IRS Form W-9, W-8BEN, or W-8BEN-E, as applicable), and understands that failure to furnish a valid taxpayer identification may result in mandatory withholding.
